These Terms of Service (“Terms”) govern your use of the website (shinobasa.com) and applications (including, without limitation, Monny San) (collectively, the “Services”) operated by Shinobasa (“we,” “us,” or “our”).
By using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Scope
- These Terms apply to all interactions between us and users of the Services.
- Additional policies (such as our Privacy Policy) are incorporated by reference and form part of these Terms.
- In the event of a conflict, specific policies prevail over these general Terms.
2. Definitions

3. Account Registration
- You agree to provide accurate and current information when registering.
- We may refuse or revoke registration in the following cases:
- Provision of false information
- Prior suspension for violations
- Minors without legal guardian consent
- Association with anti-social forces
- Any other circumstance we reasonably deem inappropriate
- You must update your registration information promptly when it changes.
- You are responsible for the confidentiality of your credentials. We are not liable for losses resulting from unauthorized use of your Account.
4. Age Requirements
- The Services are intended for users aged 13 or older (16 or older for EU residents, or the age prescribed by applicable law).
- Minors must obtain prior consent from a legal guardian before using the Services.
- If a minor uses the Services without guardian consent, we disclaim all liability.
5. Subscriptions and Billing
5.1 Plans
Premium features of Monny San are offered as a monthly or annual subscription.
- Reference price (Japan): ¥480 / month or ¥3,800 / year (tax included)
- Actual selling price: Please refer to the price displayed in Apple App Store or Google Play
- Prices are displayed on your device based on your region, currency, exchange rate, and store settings
- All displayed prices include applicable taxes
5.2 Auto-Renewal
- Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.
- Renewal fees are charged to your registered payment method within 24 hours of the current period’s end.
- To cancel auto-renewal, use your device OS settings:
- iOS: Settings > Apple ID > Subscriptions
- Android: Google Play > Subscriptions
5.3 Free Trials
If a free trial is offered, it will automatically convert to a paid subscription unless canceled at least 24 hours before the trial ends.
5.4 Refunds
- Refunds follow Apple App Store / Google Play Store policies.
- Refund requests must be submitted directly to the relevant store:
- We generally do not issue refunds for services already provided, except where required by store policy or applicable consumer protection law.
5.5 Price Changes
- We may modify subscription prices.
- Material price changes will be announced at least 30 days before the effective date.
- You may cancel before the effective date if you do not accept the change.
6. Prohibited Conduct
You agree not to:
- Violate any applicable law or public order and morality
- Engage in criminal activity
- Infringe on intellectual property, privacy, or other rights of Shinobasa, users, or third parties
- Place undue load on our infrastructure
- Interfere with Service operations
- Attempt unauthorized access, reverse engineering, decompilation, or disassembly
- Harvest or collect information about other users
- Impersonate others
- Transmit malware or harmful code
- Resell or redistribute the Services commercially without our prior written consent
- Use automated tools (bots, scrapers) against the Services
- Store or transmit illegal content through the Services
- Engage in money laundering, terrorism financing, or other illegal financial activity
- Access the Services from sanctioned countries or regions (UN, US, EU, Japan sanction lists)
- Engage in any other conduct we reasonably deem inappropriate
7. Intellectual Property
7.1 Our Rights
- All rights (copyright, trademark, etc.) in the Services belong to Shinobasa or respective rights holders.
- You are granted a non-exclusive, non-transferable, non-sublicensable license to use the Services personally, which terminates upon termination of these Terms.
7.2 User Content
- Copyright in content you create through the Services (e.g., budget data) remains yours.
- You grant us a non-exclusive, royalty-free, worldwide license to reproduce, display, and distribute such content solely to the extent necessary to provide and improve the Services.
- We use aggregated, anonymized data only for analytics; we do not disclose individual user content to third parties.
8. Disclaimers
8.1 No Warranty
- The Services are provided “AS IS” and “AS AVAILABLE,” without warranty of any kind, express or implied, including but not limited to warranties of fitness for a particular purpose, merchantability, accuracy, or non-infringement.
- We do not warrant that the Services will meet your specific needs, be uninterrupted, error-free, or secure.
8.2 Not Financial Advice
- Monny San is a budgeting tool. It does not provide financial, investment, tax, or legal advice.
- Consult qualified professionals for important financial decisions. We accept no liability for decisions made based on the Services.
8.3 Data Accuracy
Accuracy of data you enter is your responsibility. We do not guarantee backup or recovery of your data. Maintain your own backups of important data.
9. Limitation of Liability
- To the fullest extent permitted by law, our liability is limited as follows.
- We are not liable for the following (except in cases of willful misconduct or gross negligence):
- Lost profits or business opportunities
- Loss or corruption of data
- Indirect, special, consequential, or punitive damages
- Damages caused by third-party conduct (as further described in Section 9.3)
- Third-party attacks and force majeure: Provided we have exercised reasonable care, we are not liable for damages arising from:
- Unauthorized access, cyberattacks, hacking, or malware by third parties
- Infrastructure failures, vulnerabilities, or fault of our data processors (Supabase, Cloudflare, Apple, Google, etc.) themselves
- Outages of telecommunications or internet providers
- Force majeure: earthquakes, fires, floods, war, terrorism, pandemics, government orders, power outages, etc.
- User’s own password hygiene failures, device loss or theft, or negligence
- Allocation with processors: Where damage arises due to a processor’s own fault, we will serve as the first point of contact, investigate, and engage that processor. Final liability is then allocated between us and the processor according to applicable law and respective fault.
- Where we are liable, our aggregate liability is capped at the total amount you paid us in the 12 months preceding the claim (or, for free-tier users, a cap of JPY 5,000 or equivalent).
- Nothing in this Section limits rights that cannot be excluded under mandatory consumer protection law, statutes regarding willful misconduct or gross negligence, or other law that does not permit exclusion.
10. Suspension and Termination
10.1 By Us
We may suspend or terminate accounts without prior notice if:
- You violate Section 6 (Prohibited Conduct)
- You breach these Terms
- Registration information was false
- Your account has been inactive for 12+ months
- Continued use becomes impossible (e.g., death)
- We reasonably determine termination is appropriate
10.2 By You
- You may delete your account anytime from in-app settings.
- Related data is generally erased within 30 days after deletion (subject to legal retention).
- Active subscriptions must be canceled separately through the relevant store.
11. Modifications and Interruptions
- We may modify or suspend the Services without prior notice in cases including:
- System maintenance or updates
- Force majeure (earthquake, fire, power outage)
- Telecom failures
- Other operational needs
- We are not liable for losses arising from such modifications.
- If the Services are to be terminated permanently, we will give at least 90 days’ notice where possible.
12. Notices
- Notices from us may be made via posting on the Services, email to your registered address, or in-app notifications.
- Notices to us should be sent to shinobasajp@gmail.com or via in-Service contact forms.
13. EU Digital Services Act (DSA)
- Some offerings (including the Monny San app) exclude delivery to EU residents.
- However, the shinobasa.com website remains accessible from the EU. EU residents may report illegal content to shinobasajp@gmail.com with the subject “DSA Report.”
- We will respond to DSA Article 16 reports without undue delay.
14. Governing Law and Jurisdiction
14.1 Governing Law
These Terms are governed by and construed under the laws of Japan. However, mandatory consumer protection laws of your country or region of residence apply regardless of any provision in these Terms.
14.2 Jurisdiction
- We propose the Tokyo District Court as the court of first instance for any dispute relating to these Terms or the Services.
- However, consumers may bring proceedings before the courts of their own place of residence, regardless of country or region. This right is based on mandatory laws, including:
- Japan: Consumer Contract Act Art. 11; Code of Civil Procedure Art. 3-4 (limits on exclusive jurisdiction clauses in consumer contracts)
- EU: Brussels I Regulation (Recast), Article 18
- United Kingdom: Consumer Rights Act 2015 and related rules
- United States: State consumer protection and long-arm statutes
- Latin America: Consumer protection statutes of Mexico, Argentina, Chile, Colombia, Brazil, and other jurisdictions
- We fully respect any rights you may have as a consumer under the laws of your place of residence. Nothing in these Terms shall be construed to limit such mandatory consumer rights.
14.3 Severability
If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions remain in full force.
15. Amendments
- We may amend these Terms if:
- The change benefits users generally
- The change is reasonable in light of purpose, necessity, and content
- Material changes will be announced at least 30 days before the effective date via the Services and email.
- Continued use after the effective date constitutes acceptance.

In the event of any discrepancy between the Japanese version and this translation, the Japanese version shall prevail.
